簡介:法律教育在中國最早是作為思想啟蒙教育而引進(jìn)并傳播的是“德先生”(民主)的重要組成部分隨著社會的發(fā)展法律教育的思想啟蒙作用逐漸減弱而其與法律職業(yè)的天然聯(lián)系卻凸顯出來馬克斯韋伯說“透過任何一項(xiàng)事業(yè)的表象可以在其背后發(fā)現(xiàn)有一種無形支撐這一事業(yè)的時代精神這種以社會精神氣質(zhì)(ETHOS)為表現(xiàn)的時代精神與特定社會文化背景有著內(nèi)在的淵源關(guān)系”今天該文能討論法律教育與職業(yè)培養(yǎng)模式的關(guān)系本身就是一種社會的進(jìn)步在中國由于歷史的原因法律教育與法律職業(yè)培養(yǎng)嚴(yán)重脫節(jié)法律職業(yè)并不以經(jīng)歷系統(tǒng)的正規(guī)的法律教育作為入門條件或任職資格高等院校的法律教育基本上是按照素質(zhì)教育和通才教育來設(shè)計(jì)的該文在考察了英美法系的典型代表美國和大陸法系的典型代表德國的法律教育歷史的基礎(chǔ)上歸納出兩國法律教育的主要特點(diǎn)并用比較的方法揭示了中國現(xiàn)行法律教育的主要問題最后對中國法律職業(yè)人才培養(yǎng)模式的改革和完善提出了若干建議
