    • 簡(jiǎn)介:“以就業(yè)為導(dǎo)向發(fā)展高等職業(yè)教育”是作為解決現(xiàn)實(shí)問(wèn)題的方針而由政府提出的,它通常被簡(jiǎn)單地理解為自上而下地出臺(tái)某些措施或者倡導(dǎo)某些做法以提高畢業(yè)生的就業(yè)率。但是,如果考慮到與高職有關(guān)的各方面的切身利益,問(wèn)題就不僅在于應(yīng)不應(yīng)該以就業(yè)為導(dǎo)向,而首先需要明確這種就業(yè)導(dǎo)向究竟應(yīng)該是誰(shuí)的就業(yè)導(dǎo)向。本文從現(xiàn)實(shí)世界中最為根本的“利益”著眼,以學(xué)校、學(xué)生和企業(yè)等利益主體的目標(biāo)與選擇為出發(fā)點(diǎn),構(gòu)建了“基于利益主體選擇”的就業(yè)導(dǎo)向的分析框架,以此與目前流行的“基于社會(huì)發(fā)展需要”的就業(yè)導(dǎo)向研究模式區(qū)分開(kāi)來(lái)。本文認(rèn)為,所謂“就業(yè)導(dǎo)向”就是由各方主體的行為選擇達(dá)到的某種“共贏”狀態(tài),在實(shí)踐中,或者表現(xiàn)為高職院校與企業(yè)之間形成密切的合作關(guān)系,滿足特定職業(yè)崗位的人力資本專(zhuān)用性要求,使畢業(yè)生免于勞動(dòng)力市場(chǎng)上的完全競(jìng)爭(zhēng);或者是在企業(yè)不參與職業(yè)教育的前提下,某一學(xué)校努力使自身培養(yǎng)的專(zhuān)業(yè)人才具有優(yōu)于各校同等條件競(jìng)爭(zhēng)時(shí)就業(yè)前景。本文將社會(huì)分層與個(gè)體選擇的分析方法、博弈論以及交易成本的理論與方法綜合應(yīng)用到高職就業(yè)導(dǎo)向問(wèn)題的研究,客觀揭示出學(xué)校、學(xué)生和企業(yè)等利益主體的理性偏好,并致力于考察彼此之間策略的相互影響。特別是為不完全信息條件下技能型人才培養(yǎng)過(guò)程中學(xué)校與企業(yè)雙方的行為選擇提供了規(guī)范化解釋。文章從不同利益主體的角度探討了高等職業(yè)教育“特色”與“一流”的內(nèi)涵。論證了“預(yù)期職業(yè)地位”的概念,進(jìn)而提出贊成或反對(duì)現(xiàn)在以至將來(lái)可能出現(xiàn)的有關(guān)“以就業(yè)為導(dǎo)向”發(fā)展高職的種種設(shè)想與做法的判別標(biāo)準(zhǔn)“單一規(guī)則”,亦即能否盡可能地提升受教育者的預(yù)期職業(yè)地位。

    • 簡(jiǎn)介:在近期的教育大事件中,修改高等教育法可稱(chēng)是一項(xiàng)重量級(jí)任務(wù)。但要如何修改,學(xué)者們眾說(shuō)紛紜,其依據(jù)也不盡相同,在這此背景下,本文希通過(guò)辟?gòu)桨l(fā)展中國(guó)家高等教育立法的進(jìn)程和經(jīng)驗(yàn)來(lái)對(duì)我國(guó)的高等教育立法作一較為客觀的評(píng)價(jià),并針對(duì)高等教育法的修改歸納出一些切實(shí)可行的建議供參考。之所以選擇發(fā)展中國(guó)家,其一是我們置身其中,其二是這個(gè)群體已經(jīng)龐大到足以形成內(nèi)部的兩極分化(全世界有超過(guò)80%的人生活在發(fā)展中國(guó)家),換言之,其間領(lǐng)先國(guó)家的以法治教之道已經(jīng)足夠我們學(xué)習(xí)借鑒上一陣,甚至于在某些方面,這些發(fā)展中國(guó)家?guī)Ыo我們的啟示可能比我們汲取自發(fā)達(dá)國(guó)家的經(jīng)驗(yàn)更適于現(xiàn)階段的實(shí)踐。本文選取亞非拉三大洲的9個(gè)代表國(guó)家為重點(diǎn)考察對(duì)象,間或鋪展到更廣的層面。從探究這些發(fā)展中國(guó)家的高等教育立法現(xiàn)狀出發(fā),總結(jié)其高等教育立法特點(diǎn);以這些特點(diǎn)為線索,從公共利益和高等教育管理兩個(gè)維度來(lái)分析高等教育立法的重點(diǎn)及其影響因素;對(duì)應(yīng)立法重點(diǎn),從一些特定法律法規(guī)來(lái)跟蹤其立法成效,探析影響因素背后的根本原因;最后,在以上研究的基礎(chǔ)上,對(duì)我國(guó)高等教育立法體系的建設(shè)提出相應(yīng)建議,并對(duì)高等教育法的修改總結(jié)若干方面的思路。高等教育的法制建設(shè)需要緊扣社會(huì)現(xiàn)實(shí),研究有或在不久前經(jīng)歷相似發(fā)展背景和挑戰(zhàn)的其他發(fā)展中國(guó)家的法治策略、總結(jié)正反兩方面的經(jīng)驗(yàn),這些都將有助于我們走出更寬廣的中國(guó)特色高等教育之路。
