3、ralTradeNegotiationsTakingnoteoftheReptoftheWkingPartyontheAccessionofChinaindocumentWTACCCHN49(“WkingPartyRept“)HavingregardtotheresultsofthenegotiationsconcerningChinasmembershipintheWTOAgreeasfollows:PartIGeneralProvi

4、sions1.General1.UponaccessionChinaaccedestotheWTOAgreementpursuanttoArticleXIIofthatAgreementtherebybecomesaMemberoftheWTO.2.TheWTOAgreementtowhichChinaaccedesshallbetheWTOAgreementasrectifiedamendedotherwisemodifiedbysu

5、chlegalinstrumentsasmayhaveenteredintofcebefethedateofaccession.ThisProtocolwhichshallincludethecommitmentsreferredtoinparagraph342oftheWkingPartyReptshallbeanintegralpartoftheWTOAgreement.3.Exceptasotherwiseprovidedfint

6、hisProtocolthoseobligationsintheMultilateralTradeAgreementsannexedtotheWTOAgreementthataretobeimplementedoveraperiodoftimestartingwithentryintofceofthatAgreementshallbeimplementedbyChinaasifithadacceptedthatAgreementonth

7、edateofitsentryintofce.4.Chinamaymaintainameasureinconsistentwithparagraph1ofArticleIIoftheGeneralAgreementonTradeinServices(“GATS“)providedthatsuchameasureisrecdedintheListofArticleIIExemptionsannexedtothisProtocolmeets

8、theconditionsoftheAnnextotheGATSonArticleIIExemptions.readilyavailabletootherWTOMembersindividualsenterprisesshallbeenfced.InadditionChinashallmakeavailabletoWTOMembersuponrequestalllawsregulationsothermeasurespertaining

9、toaffectingtradeingoodsservicesTRIPSthecontroloffeignexchangebefesuchmeasuresareimplementedenfced.Inemergencysituationslawsregulationsothermeasuresshallbemadeavailableatthelatestwhentheyareimplementedenfced.2.Chinashalle

10、stablishdesignateanofficialjournaldedicatedtothepublicationofalllawsregulationsothermeasurespertainingtoaffectingtradeingoodsservicesTRIPSthecontroloffeignexchangeafterpublicationofitslawsregulationsothermeasuresinsuchjo

11、urnalshallprovideareasonableperiodfcommenttotheappropriateauthitiesbefesuchmeasuresareimplementedexceptfthoselawsregulationsothermeasuresinvolvingnationalsecurityspecificmeasuressettingfeignexchangeratesmoarypolicyotherm

12、easuresthepublicationofwhichwouldimpedelawenfcement.Chinashallpublishthisjournalonaregularbasismakecopiesofallissuesofthisjournalreadilyavailabletoindividualsenterprises.3.Chinashallestablishdesignateanenquirypointwhereu

13、ponrequestofanyindividualenterpriseWTOMemberallinfmationrelatingtothemeasuresrequiredtobepublishedunderparagraph2(C)1ofthisProtocolmaybeobtained.Repliestorequestsfinfmationshallgenerallybeprovidedwithin30daysafterreceipt

14、ofarequest.Inexceptionalcasesrepliesmaybeprovidedwithin45daysafterreceiptofarequest.Noticeofthedelaythereasonstherefshallbeprovidedinwritingtotheinterestedparty.RepliestoWTOMembersshallbecompleteshallrepresenttheauthitat

15、iveviewoftheChinesegovernment.Accuratereliableinfmationshallbeprovidedtoindividualsenterprises.(D)JudicialReview1.Chinashallestablishdesignatemaintaintribunalscontactpointsproceduresfthepromptreviewofalladministrativeact

16、ionsrelatingtotheimplementationoflawsregulationsjudicialdecisionsadministrativerulingsofgeneralapplicationreferredtoinArticleX:1oftheGATT1994ArticleVIoftheGATStherelevantprovisionsoftheTRIPSAgreement.Suchtribunalsshallbe

17、impartialindependentoftheagencyentrustedwithadministrativeenfcementshallnothaveanysubstantialinterestintheoutcomeofthematter.2.Reviewproceduresshallincludetheopptunityfappealwithoutpenaltybyindividualsenterprisesaffected

18、byanyadministrativeactionsubjecttoreview.Iftheinitialrightofappealistoanadministrativebodythereshallinallcasesbetheopptunitytochoosetoappealthedecisiontoajudicialbody.Noticeofthedecisiononappealshallbegiventotheappellant
